Dusk Group Limited (ASX: DSK) has announced that the Australian Competition and Consumer Commission (ACCC) has commenced legal proceedings against Dusk Australasia Pty Ltd, a wholly-owned subsidiary of Dusk Group, in the Federal Court of Australia. The proceedings relate to alleged contraventions concerning certain products sold between calendar 2023 and 2024, specifically those containing button batteries. The allegations include that 25 product lines were supplied or offered for supply before safety standard testing had been completed, although the pleadings note that the products passed the relevant tests when tested. Additionally, it is alleged that 4 product lines did not display required warning information and were voluntarily recalled in December 2024. Dusk Group has not identified any reports of harm to customers associated with these products and continues to monitor customer feedback. The proceedings also allege that Dusk Australasia Pty Ltd breached the terms of an undertaking given to the ACCC in 2023. Dusk Group takes product safety seriously and has cooperated fully with the ACCC throughout its investigation. As the matter is now before the Federal Court, Dusk Group will not comment further at this time and will keep the market informed in accordance with its continuous disclosure obligations.
